LEGAL EXPERIENCE

Application and Prosecution
: Foreign and domestic patent application preparation and prosecution including appeals to Board of Patent Appeals and Interferences; drafting and prosecuting patent applications in technical areas including mechanical and aerospace systems, computer hardware and software, GUI applications, fuel cells, combined heat and power systems, business methods, electronics, manufacturing processes, telecommunications and wireless systems.

Client consultation: Patent, trade secret, copyright, trademark, unfair competition, licensing; prior art analyses; portfolio management and intellectual property strategies. Drafted confidentiality, employee proprietary information agreements, joint development, collaboration, software license, and other intellectual property agreements. Prepared numerous non-infringement and invalidity opinions.

In-House IP Attorney: Served as in-house IP Attorney for corporate research center of a Fortune 50 corporation. Counseled clients on a wide variety of intellectual property matters, including freedom to practice opinions. Negotiated numerous intellectual property, joint development, software licenses and other agreements with both domestic and foreign corporations. Developed intellectual property strategies for technical projects at different stages of development.

Litigation: Patent infringement defense; witness interviews and preparation; discovery and settlement negotiations; deposition defense; motions and oral hearings. Drafting complaints, subpoenas, motions, appellate briefs, requests for production, interrogatories, and deposition strategies. Conducting due diligence and patent analyses. Experience in patent, trade secret, unfair competition, death penalty appeal, and commercial contract matters.

TECHNICAL EXPERIENCE


Mr. Nickelson has three years of engineering experience as a guidance, navigation and control (GNC) flight controller for the NASA Space Shuttle program at NASA’s Johnson Space Center. Mr. Nickelson’s experience focused on guidance software and navigation and control hardware, as well as interfaces with power and hydraulic systems. Mr. Nickelson has extensive technical experience with mechanical systems, such as Space Shuttle components and the spacesuit, as well as with astronautics, such as orbit prediction and determination. Mr. Nickelson’s experience has also extended to engineering analysis, fault and redundancy management, flight design and dynamics, and programming in a variety of languages.
